SummerArtCircle.com is a private online service operated by Avail Art, L.L.C. (“Avail Art”) that connects people through networks of friends and colleagues for participation in arts related offline events and activities (the “Service”). To accomplish this, our Members create their own profiles which are shown to other Members of the Service. To fulfill the purpose of this site, some profile information we ask for is displayed to people within these personal networks. Members can change their profile information at any time and can control how other Members and the Service communicates with them.
Avail Art cares deeply about online privacy. We will never rent or sell your personally identifiable information to third parties for marketing purposes. We will never share your contact information with another Member. Any sensitive information you provide will be secured with all industry standard protocols and technology.
Notice of all changes that materially affect ways in which your personally identifiable data may be used or shared will be posted in updates to our Privacy Policy. If you continue to use the Service after notice of changes has been published on our Website, you hereby provide your consent to the changed practice.
Please read this privacy policy to learn more about:
Avail Art collects Member-submitted account information such as name and email address to identify users and send notifications related to the use of the Service. Avail Art also collects Member-submitted profile information such as education, location, and home town in order to assist Members in finding and communicating with each other.
Profile information as well as names and photos are displayed to all Members, to support the function of the site as a private community where Members can meet new people through their friends and colleagues. Members within a personal network communicate on the Website with each other through the Service, without disclosing email addresses. We may also use a Member's email address to send weekly updates or news regarding the Website or the Service, but Members may choose not to receive email of this type by accessing My Profile.
Avail Art also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from Members and visitors to the Website. This data is used on an aggregated basis to do such things as manage the Website, track usage and improve the Website Services. We may share non-personal information with third parties for advertising, promotional and other purposes. Due to the communications standards on the Internet, when you visit the Website we automatically receive the URL of the site from which you came and the site to which you are going when you leave the Website.
As a matter of policy, we do not sell, rent, share, trade or give away any of your personal information unless required by law. However, Avail Art may share profile information and aggregate usage information in a non-personally identifiable manner to program partners, advertisers and other third parties in order to present to Members more targeted services and products. In such situations we will never disclose information that will be used to personally identify you.
It is possible that we may need to disclose personal information when required by law. We will disclose such information when we have a good-faith belief that it is necessary to comply with a court order, ongoing judicial proceeding, or other legal process served on our company or to exercise our legal rights or defend against legal claims. Avail Art reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Avail Art or substantially all of its assets to that successor in interest.

This privacy statement applies solely to information collected by this Website.
We reserve the right to utilize cookie technology. A cookie is a piece of data stored on the user's computer tied to information about the user. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a text file stored on the user's hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. Cookies are used to manage sessions on our Website. Most browsers are initially set up to accept cookies; however, you can reset your browser to refuse all cookies or indicate when a cookie is being sent or you can flush your browser of all cookies from time to time. Members must enable cookies to use our Website and as such, if you choose to disable your cookies setting or refuse to accept a cookie, you will not be able to access this Website. Also, Members may optionally use a cookie to remember their password in order to automatically log in to our Website. We do not and will not use cookies to collect private information from any Member that is not intentionally submitted to us.
At times, some of the advertisers on our Website and their ad service providers set cookies when you click their advertising banners. While we use cookies in other parts of the Website (as discussed above), cookies received with banner ads are collected by those advertisers and their ad service providers, and we do not have access to that information. The ad company’s privacy policy and/or that of its service provider will govern the use of this information and we are not responsible for the privacy practices of such ad company.
Members may modify or remove any of their personal information at any time by logging into their account and accessing features such as My Profile. We are not responsible for updating information contained in third-party lists or databases.
If we change our privacy policy, we will post those changes on the Website so our Members are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
Please keep in mind that whenever you voluntarily disclose personal and profile information online—for example on forums, chat rooms, message boards, news groups or through e-mail—that information can be collected, viewed and used by others. In short, by posting personal and profile information online that is publicly accessible to other Members, you may receive unsolicited messages from other parties in return. You should exercise caution when deciding to disclose your personal and profile information in these areas, since anyone may use publicly posted information.

You may have certain rights under the Communications Act, Federal Trade Commission Act, and other state and federal statutes that may apply, and by accepting these terms and using this Website, you are waiving all of these rights as to collection, use, disclosure and storage of your personally identifiable and non-personal information as described above.
